President Biden opposes expanding the Supreme Court, but former Congressman David Jolly argues that it is the only way to bring balance to the justice system.
Jolly, a Republican who served in Congress from 2014 to 2017, said that the Supreme Court has become “an ideological strategy decades in the making” by Republicans. He pointed to the court’s recent rulings on abortion and LGBTQ rights, which he said have rolled back progress made in the 20th century.
“The anxiety of many Americans, they feel now that the Supreme Court is outside of the reach of accountability,” Jolly said. “The American people say, wait a minute, the court is going in a direction that I’m not necessarily comfortable with. And I think we have to rift.”
Jolly admitted that he is a “recent convert” to expanding the Supreme Court, but he said that he believes it is necessary to protect democracy and our rights. He pointed out that the Constitution does not specify the number of justices on the Supreme Court, and that the number has changed six times in the past.
“I think Democrats can make the case substantively on protection of rights, but also a clear analytical case for why this is an era in which we can consider expanding the court,” Jolly said. “And then the passionate arguments about McConnell stopping Merrick Garland and greenlighting Barrett are just fuel to the fire for what is a rational argument to protect democracy and protect our rights today.”
Jolly’s comments come as Democrats are increasingly considering expanding the Supreme Court in response to the recent rulings. However, it is unclear whether they have the votes to do so, as some moderate Democrats have expressed concerns about the precedent it would set.
The debate over expanding the Supreme Court is likely to be a major issue in the upcoming midterm elections. Democrats will need to win control of the Senate in order to have a chance of passing legislation to expand the court. If they are successful, it would be a major victory for the party and a significant shift in the balance of power in the United States.
