Epshteyn, a longtime adviser to Donald Trump, has been accused of helping to organize a plan to send fake electors to Congress in an attempt to overturn the results of the 2020 election. In an interview with MSNBC, former prosecutor Harry Litman said that Epshteyn’s own words could be used against him in court.

In the interview, Epshteyn referred to the fake electors as “alternate electors.” However, Litman said that this is a misnomer. “It is not alternate electors,” Litman said. “It is fraudulent electors. It’s people that are sign pieces of paper saying, ‘My state, has made me an elector and I’m for Trump,’ when exactly the opposite has happened.”

Litman said that Epshteyn’s admission could be used as evidence of a crime. “That is just a straightforward crime of defrauding the United States and probably a wire fraud as well,” Litman said.

Another of Trump’s campaign officials is already cooperating with the special counsel on the fake electors scheme. This suggests that the special counsel is close to bringing charges in the case.

If Epshteyn is indicted, he would be the latest in a string of Trump associates to face charges related to the January 6th attack on the Capitol. The charges against Epshteyn would be a significant development in the investigation, as they would show that the fake electors scheme was not just a fringe idea, but a serious attempt to overturn the results of the election.
